Announcement of State Intellectual Property Office

In October of 2003, the International Bureau under World Intellectual Property Organization£¨WIPO£©amended the items and standards of fees in connection with PCT international applications, in accordance with the requirements of WIPO, hereby we make the announcement of the amended items and standards for PCT as follows:

I. The items and standards of fees for the PCT applications in the international phase (in RMB)

1. Fees collected by SIPO for the International Bureau under WIPO
(1) International application fee
  1) International application documents no more than 30 pages, 8555
  2) Extra fee for each page exceeding 30 pages, 90/page
(2) Formalities fee 1223

2. Fees collected by the SIPO
(1). Forwarding fee 500
(2). Search fee 1500
Additional search fee 1500
(3). Fee for claiming priority 150
(4). Preliminary examination fee 1500
Additional preliminary examination fee 1500
(5). Opposition fee for unity 200
(6). Copying fee for duplicates (each page) 2
(7). surcharge collected 50% of payable, no less than forwarding fee and no more than 50% of 1£©for the international application.

II. The items and standards of fees for the PCT applications entering Chinese national phase (in RMB)

1. Grace period fee 1000
2. Formalities fee for collecting mistakes in the translation (in preliminary examination) 300
3. Formalities fee for collecting mistakes in the translation (in substantive examination) 1200
4. Restoration fee for unity 900
5. Fee for requesting to amend priority claims 300

III. Explanations

The SIPO collects the above application fees and formalities fees stipulated in the announcement for the International Bureau of WIPO, and the standard of fees is in accordance with the foreign exchange rate promulgated on December 31, 2003 by State Administration of Foreign Exchange.

The actual fees collected shall be accounted according to the foreign exchange rate of the date on which SIPO forwards the fees to the International Bureau of WIPO.

The above standards for fees shall take effect as of January 1, 2004 in accordance with the requirements of WIPO.
