Two Months After Patent License, Yuanyuzhi Sued BIWIN Over the Infringement of the SEP of eMMC and Claimed CNY 1.21 M+ for Compensation
On June 24, Shenzhen BIWIN Storage Technology Co., Ltd. (BIWIN) announced that BIWIN was sued by Yuanyuzhi, a wholly-owned subsidiary of Shenzhen Longsys, for infringing its SEP of eMMC. Yuanyuzhi brought two lawsuits before Nanjing Intermediate People’s Court demanding BIWIN and Jiangsu Jinzhen Cellphone Trading Chain Co., Ltd stop the infringement, destroy the inventory, and pay damages for more than CNY 1.21 million.
Patents involved are two invention patents, of which the protection period expires on Nov. 27th, 2026. The two patents were originally applied by Nokia and ended up with licensing to Yuanyuzhi by Memory Technologies LLC after multiple transfers. Yuanyuzhi stated that it has fulfilled the obligation of FRAND and accused BIWIN of misconduct during negotiations. CNY 2M Compensation Retained in Final Judgement for the Trademark “广州酒家”(Guangzhou Restaurant)
Company A is a recognized China Time-honored Brand and its moon cake “广州酒家” enjoys a high reputation. In 2020, Company A found Company B use the mark “广洲人家” to sell moon cake, and thus filed a lawsuit asserting the bad faith of taking free ride of Company A’s brand.
The first instance Court ruled that Company B established the infringement and should pay CNY 2M in compensation. The two parties appealed, and Guangzhou Intellectual Property Court determined Company B constituted an infringement of Company A’s trademark for improper use of registered trademark with obvious intention and severe circumstances. In the end, the court dismissed the appeal and upheld the original judgment.

China’s First Packaging and Decoration Infringement Lawsuit Filed by “家樂” Announced with a Full Support of the Claimed CNY 5M Punitive Damages
On June 9, 2025, “家樂” (Knorr), a brand under Unilever filed China's first-ever packaging and decoration infringement case before the Taizhou Intermediate People’s Court, suing a number of enterprises conducted comprehensive imitation, including trademark, and packaging color and bottle design, which can easily confuse the consumer.
The court ruled that the defendants’ act constituted trademark infringement and unfair competition with obvious bad faith and severe circumstances. The court granted the plaintiff’s claim for punitive damages of CNY 5 million in full during the hearing, and ordered the defendants to destroy of all infringing products and materials, as well as to publish a statement in newspapers to eliminate adverse effects. This trial proceeded strictly by procedural standards and efficiently, earning high praise from NPC deputies, corporate representatives, and intellectual property departments. China’s Smart Glasses Patents Exceeds 7,000 with the Market Booming
As of 2025, the number of China’s patents related to smart glasses exceeded 7,000, including more than 4,000 valid patents and over 2,000 invention patents. Leading applicants include companies such as DreamSmart and 3e Electronics. The application keeps increasing in recent ten years and hits 1,000 for the first time in 2021. According to IDC, the shipment of China smart glasses is expected to reach 2.75 million in 2025, witnessing a raise by 107% annually and holding 21% of global market share. Breakthrough in technologies like Micro-OLED, optical waveguide, and etc., makes the product a lighter one and able to enter mass production, while prices continue to drop. China’s Anti-Unfair Competition Law Amended to Strengthen Online Platform Regulation
On June 27th, 2025, the Standing Committee of the National People’s Congress passed the newly amended Anti-Unfair Competition Law, which will take effect on October 15. This marks the third amendment to the law since its initial implementation in 1993, with key revisions targeting emerging issues in the digital economy era.
The newly amended law explicitly prohibits platforms from forcing merchants to sell products below cost price, preventing market-disrupting strategies like “lowest price guarantees.” It also requires platforms to establish fair competition rules and complaint scheme to promptly address acts involving unfair competition. New amendments detailed the regulations and enhanced the protection on data, specifically target digital-era unfair competition behaviors including ad-blocking, algorithmic price discrimination, and fake transactions.
