IP5 PCT CS&E Pilots to Be Launched on July 1st

Upon authorization of IP5 Co-operation Conference of Directors of the European Patent Office, the Japan Patent Office, the Korean Intellectual Property Office, the State Intellectual Property Office of the People’s Republic of China, and the United States Patent and Trademark Office (the IP5), the IP5 will jointly launch a PCT Collaborative Search and Examination (CS&E) pilot project, which will start from July 1st, 2018 and will last for a period of two years.
 
By report, when the project is launched, a Chinese applicant can file a request before the State Intellectual Property Office (the SIPO) for participation in this pilot at the filing of an English PCT international application. If the request is approved, the SIPO will collaborate with the European Patent Office, the Japan Patent Office, the Korean Intellectual Property Office, and the United States Patent and Trademark Office  in the search and review of the PCT application in the international phase, and will complete the PCT international search report with reference to the review opinions from the European Patent Office, the Japan Patent Office, the Korean Intellectual Property Office, and the United States Patent and Trademark Office. After half a year or one year of the pilot project, the SIPO will further accept participation request for Chinese PCT applications. By then, the applicant can file before the SIPO a request for participation in the pilot project at the filing of a Chinese PCT international application.
