Zhejiang Pharmaceutical Won Coenzyme Q10 Patent Infringement Case

Recently, Zhejiang Pharmaceutical Co., Ltd. won in the final determination of “337 investigations” of coenzyme Q10 conducted by the US International Trade Commission.

On June 17, 2011, the Japanese Kaneka Company filed with International Trade Commission and claimed that the coenzyme Q10 products exported to US by seven companies including Zhejiang Pharmaceutical and the manufacturing process infringed their patent and requested to start “337 investigations” and issue exclusion order and injunction order.

On July 14, 2011, the US International Trade Commission started the investigation.

On September 27, 2012, the Administrative Law Judge made initial determination that Zhejiang Pharmaceutical won the case. At the end of 2012, the US International Trade Commission finally determined that Zhejiang Pharmaceutical did not infringe the claims of the No.340 patent registered by Japanese Kaneka Company in US and did not violate the Section 337.
